Terms and Conditions for Winternet Services
This is an agreement between StarNet Communications, Inc. (hereinafter called Winternet) and the Customer and supercedes any other written and oral agreement. Upon notice published on-line via Winternet, Winternet may change these terms and conditions, and/or change the prices charged for these services, and/or discontinue or change the services offered. Use of the Customer's account after publication date constitutes acceptance of the new terms and conditions.
Provision of Services
Winternet will provide services on its host computing systems to individual customers in exchange for payment of fees and compliance with the terms and conditions of this document and accompanying Acceptable Use Policy (AUP). Winternet services are defined as the use by the Customer of computing, telecommunications, software, and information services provided by Winternet. These services also include the provision of access to computing, telecommunications, software, and information services provided by others via the world-wide computer network known as the Internet.
Winternet will bill the Customer subscription and connection fees as set forth in Winternet's current rate schedule. Service payments must be submitted in advance of receiving services. Invoices are printed 15 days in advance. Delinquent accounts are those that remain unpaid at the beginning of each accounting cycle. Delinquent accounts may be placed on credit hold. A suspension notice will be sent to the Customer. There is a $20.00 reconnection fee to remove the Customer from credit hold status. If Winternet does not receive a response from the Customer concerning his/her suspended account within one month, the Customer's account will be closed and all files purged. There is a $25.00 charge for each returned check. The Customer's account will be put on credit hold until the debt is satisfied. Winternet does not re-deposit returned checks.
Account and Agreement Terms
This agreement shall remain in effect until the Customer terminates his/her account or Winternet cancels the Customer's account. The Customer shall notify Winternet in writing via U.S. Mail or Fax of his/her intent to cancel. Cancellation will become effective immediately, unless other arrangements are made by the Customer. The Customer is responsible for all charges incurred through this time. If Winternet cancels an account, charges incurred through the date of cancellation are the Customer's responsibility. Non-use of an account does not constitute a cancellation. Winternet reserves the right to suspend or cancel an account at anytime. (Including, but not limited to: past due accounts, violation of federal or state law, copyright or patent infringements, sending unsolicited commercial e-mail (SPAM), etc...)
Abuse of Winternet Services
Any use of Winternet system resources that disrupts the normal use of the system for other Winternet customers is considered to be an abuse of system resources. Depending on the nature and severity of the abuse, the user may receive an E-mail warning, have their processes halted, or have their account suspended by an administrator. If the misuse is unintentional, the suspension may be rescinded following a discussion with the suspending administrator. If the misuse is intentional, the suspension may be rescinded at the discretion of the administrators. Use of Winternet systems to produce mass unsolicited mailing will be charged a fine of $1000.00 and the account closed. Winternet reserves the right to monitor the Customer's actions when necessary to determine whether or not the Customer is violating the conditions of use.
Security of Accounts
Winternet Personal accounts are for individual users. The Customer agrees not to share the password or use of the account with others, including but not limited to other family members or business associates.
Offensive or Adult Materials
Winternet exercises no control over the content of materials accessed through Winternet. Some materials may be offensive or adult in nature.
Winternet makes no warranties of any kind, whether expressed or implied, for its services. Winternet specifically disclaims any implied warranties. Winternet will not be responsible for any losses or damages resulting from delays, non-deliveries, service interruption, or Customer errors or omissions. Winternet will not under any circumstance be responsible for consequential damages. If any provision of this agreement is held by a court of competent jurisdiction to be contrary to the law, the remaining provisions of this agreement will remain in full force and effect.
